End-User License Agreement (EULA)

Effective Date: 1st November 2024

This End-User License Agreement ("Agreement" or "EULA") is a legal contract between you ("User" or "You") and Mystery Bag ("we," "us," or "our") for the use of the Mystery Bag platform, including its mobile application, website, and related services (collectively referred to as the "Platform").

By accessing or using the Platform, you agree to be bound by the terms of this EULA. If you do not agree with these terms, you may not use the Platform.

1. License Grant

1.1. License to Use:

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Platform for personal, non-commercial purposes, subject to the terms of this Agreement. This license does not permit you to distribute, modify, reverse-engineer, or sublicense the Platform.

1.2. Restrictions:

You may not:

  • Use the Platform for any illegal, unauthorized, or fraudulent purposes.

  • Copy, reproduce, alter, distribute, or create derivative works from the Platform.

  • Reverse-engineer, decompile, or disassemble the Platform, except where explicitly permitted by applicable law.

2. Ownership

2.1. Intellectual Property:

The Platform and all content, features, and functionality (including but not limited to trademarks, logos, text, images, graphics, and software) are owned by Mystery Bag or its licensors and are protected by local and international intellectual property laws.

2.2. No Transfer of Ownership:

This Agreement does not transfer ownership of any intellectual property rights to you. You are granted only a limited license to use the Platform in accordance with this Agreement.

3. User Responsibilities

3.1. Account Registration:

  • To access certain features, you may need to create an account. You agree to provide accurate and up-to-date information during registration and to keep your account credentials confidential.

  • Any unauthorized access or breach of your account must be reported immediately to Mystery Bag.

3.2. User Conduct:

You agree not to:

  • Use the Platform for any purpose that is harmful, offensive, or unlawful under Egyptian laws, including but not limited to the Penal Code and Cybercrime Law (Law No. 175 of 2018).

  • Interfere with the operation, security, or availability of the Platform.

  • Upload or distribute malicious code, viruses, or harmful software through the Platform.

4. Privacy and Data Usage

4.1. Privacy Policy:

Your use of the Platform is governed by our Privacy Policy, which complies with the Personal Data Protection Law (Law No. 151 of 2020) and outlines how we collect, use, and protect your personal data.

4.2. Data Use:

By using the Platform, you consent to the collection and processing of your personal information as described in our Privacy Policy.

5. Termination

5.1. Termination by Us:

  • We reserve the right to suspend or terminate your access to the Platform, without prior notice, if you breach any terms of this Agreement.

  • Additional grounds for termination include fraud, misuse, or any activity deemed unlawful under Egyptian law.

5.2. Termination by You:

You may terminate this Agreement at any time by ceasing to use the Platform and uninstalling related applications from your devices.

5.3. Effect of Termination:

Upon termination:

  • Your license to use the Platform will immediately cease.

  • You must uninstall and delete all copies of the Platform from your devices.

6. Disclaimer of Warranty

6.1. Platform Availability:

The Platform is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free use of the Platform.

6.2. No Warranty:

We disclaim all warranties, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except where prohibited by applicable Egyptian law.

7. Limitation of Liability

7.1. Exclusion of Damages:

To the fullest extent permitted by Egyptian law, Mystery Bag is not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.

7.2. Cap on Liability:

Our liability to you for any claims arising under this Agreement shall be limited to the amount paid by you for the use of the Platform in the 12 months preceding the claim.

8. Indemnity

You agree to indemnify, defend, and hold harmless Mystery Bag, its affiliates, officers, and employees from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from:

  • Your use of the Platform.

  • Any breach of this Agreement.

  • Violations of applicable laws or third-party rights.

9. Changes to the Agreement

We may modify or update this Agreement at any time. When changes are made, we will post the updated version on the Platform and update the "Effective Date." Continued use of the Platform after changes constitutes acceptance of the revised terms.

10. Governing Law and Dispute Resolution

  • This Agreement is governed by the laws of Egypt.

  • Any disputes arising under or in connection with this Agreement shall be resolved in accordance with Egyptian arbitration laws or in the courts of Cairo, Egypt.
